{"id":6069,"date":"2025-10-01T21:17:38","date_gmt":"2025-10-01T21:17:38","guid":{"rendered":"https:\/\/bolincreek.org\/blog\/?p=6069"},"modified":"2025-10-05T21:19:19","modified_gmt":"2025-10-05T21:19:19","slug":"october-8-orange-county-board-of-adjustment-cancelled","status":"publish","type":"post","link":"https:\/\/bolincreek.org\/blog\/2025\/10\/01\/october-8-orange-county-board-of-adjustment-cancelled\/","title":{"rendered":"October 8 Orange County Board of Adjustment Cancelled"},"content":{"rendered":"<p><strong>Message from Defend Maple View Farm Community:<br \/>\n<\/strong><br \/>\n\u201dUnion Grove Farm (UGF) has withdrawn their appeal of the county\u2019s determination that their proposed amphitheater or, as they tried to characterize it, \u201cfarm stage\u201d, is not an agritourism use that is exempt from county zoning. <em>However, UGF indicated it will submit a new request for county determination with reduced capacity and some unspecified related activities. <\/em><\/p>\n<p>It is important to note that the county made a final binding determination that the proposed amphitheater \u201cis not incidental to the farm\u201d and \u201cis a principal use distinct from the farm\u201d and \u201cis contrary to a traditional notion of a rural activity\u201d. In other words, the county interpretation, determination, and denial are based on the <em>use<\/em> as an amphitheater and not its size.<\/p>\n<p>This is frustrating news, as so much time and money has been spent by community members, the attorneys for the community and TLC, as well as the attorneys for the county and county employees. Thank you to everyone who has supported the defense of our community. These donations have covered nearly all the legal fees, and we will continue to need your support if there is a new request for an inappropriate agritourism use.
